New York City Family Law
Each borough files its matrimonial cases in the Supreme Court of its county. New York County Supreme Court sits at 60 Centre Street, New York, NY 10007. Kings County Supreme Court sits at 360 Adams Street, Brooklyn, NY 11201. Queens County Supreme Court sits at 88-11 Sutphin Boulevard, Jamaica, NY 11435. Richmond County Supreme Court sits at 18 Richmond Terrace, Staten Island, NY 10301. A divorce is not heard in Criminal Court, whatever a borough address list may suggest. ToggleWhat Drives a City Case
City matters concentrate value in forms that resist easy division. Cooperative apartment shares, condominium units bought before the marriage and carried with marital income, restricted stock, carried interest, and partnership draws each raise a separate question about what is marital and what is not. Equitable distribution asks the court to weigh statutory factors, so the outcome turns on the record built during discovery rather than on a formula. Appreciation of a separate asset during the marriage can become subject to distribution when marital effort contributed to it.
Which Court Hears Your Matter
Supreme Court hears the divorce and everything that travels with it, including equitable distribution and maintenance. Family Court hears custody, visitation, and support where no divorce is pending, and handles enforcement afterward. Filing sequence matters when both are available. A borough with a heavy matrimonial calendar can also affect how quickly interim relief is heard, which is worth weighing before an action is commenced.
Frequently Asked Questions
Which borough do I file in?
Venue follows residence. Where spouses live in different boroughs, more than one county may be available, and the choice can affect the assigned part and scheduling. Decide venue before filing rather than after.
Is a co-op treated like other real estate?
A cooperative interest is personal property, shares in a corporation with a proprietary lease, not a deeded parcel. That changes how it is valued and how it is transferred, and it affects what the board can require when an interest changes hands in a divorce.
Does Criminal Court ever hear a divorce issue?
No. A matrimonial action is heard in Supreme Court. Where an order of protection is involved, that order can issue from more than one court, but the divorce itself remains in Supreme Court.
