What Drives a Long Island Case
The asset profile on the North Shore and the East End differs from much of the state. Closely held business interests, second homes, deferred compensation, and family entities formed before the marriage appear often enough that valuation becomes the center of the case rather than a side issue. Do I file in Nassau or Suffolk?
Venue follows residence. If you and your spouse live in different counties, either may be available, and the choice can affect scheduling and the part assigned. Settle venue before anything is filed, because moving a case later takes a motion and the other side may oppose it.
Will my village justice court handle the divorce?
No. Town and village justice courts have no matrimonial jurisdiction. A divorce action is commenced in Supreme Court in Nassau or Suffolk. A filing made in the wrong court does not preserve your position.
Does a prenuptial agreement end the argument?
Not by itself. A validly executed agreement controls what it covers, but disputes commonly arise over scope, over disclosure at signing, and over assets acquired afterward. The document starts the analysis rather than ending it.
