The Retainer and the Statement of Client Rights

A matrimonial retainer must be in writing and signed by both attorney and client, and the client must receive the Statement of Client’s Rights and Responsibilities. The agreement has to describe the scope of the work, the basis for fees, and how disputes over fees are resolved. Non-refundable retainers are not permitted in matrimonial matters, and a security interest in the marital residence requires court approval. These are not formalities, and an agreement that ignores them can cost the attorney the fee.

Discovery in a Contested Case

Financial disclosure is compulsory. Each side files a sworn statement of net worth, and the exchange that follows covers tax returns, account statements, entity records, and the documents behind any claim that an asset is separate. Can a retainer be non-refundable?

No. Non-refundable retainers are prohibited in matrimonial matters in New York. Unearned fees remain the client’s, and the retainer agreement must set out how any balance is returned.

Who pays the legal fees?

The Domestic Relations Law creates a rebuttable presumption that counsel fees are awarded to the less-monied spouse, so that both parties can be represented. The presumption can be overcome, and conduct during the litigation is one of the things courts weigh.

What is a statement of net worth?

It is a sworn financial disclosure listing income, expenses, assets, and liabilities, filed with supporting documents. It is the foundation of the financial case, and errors in it follow a party through the litigation because it is a document they swore to.
